Geotechnical Covenant Dispute

A geotechnical covenant or restrictive covenant is a restriction that is registered on a land title that limits the areas in which you can build on your property, which can decrease your property value. Good thing we can help you remove a restrictive covenant.

Sometimes these are put in place across large developments, without property specific checks being performed. Factor can perform a site-specific soil and slope stability investigation on your property to prove to the City of Calgary or your governing body that a geotechnical restrictive covenant is not necessary on your land, which will increase your property value and allow you to build where you want.

The process for this is generally quite simple. We will start with an initial site visit (free of charge) to determine if we believe we can remove or relax the restrictions on your land. Following the initial site visit we will provide a cost for our service to you.

Once you have given us approval to begin, we will likely drill a borehole near the top of the covenant extent and perform slope stability checks so we can prove that your land is stable for construction.

A report will be prepared that shows our slope stability checks and explains why your land is safe for further development. If you are happy with the report, you then submit it to the City of Calgary. If it is not accepted, we will engage in communication with the City to expedite the removal of the geotechnical covenant on your land title.
